1. Scope of Terms

These Terms apply to your access and use of:

• The Farmasi Lautan website(s) and mobile application(s)
• Pharmacy services and related healthcare offerings (where available)
• Digital health services such as e-consultation, telepharmacy, and virtual health assessments (where available)
• The sale of health supplements and rehabilitation products through our online store
• Medical equipment rental services (wheelchairs, hospital beds, oxygen tanks, and related items)
• Any digital or physical product or service provided through the Platform
• Promotional campaigns, rewards, or membership programs

Prescription and Pharmacy-only (Group B / Group C) medications are not sold through our online store. These are available only at our physical outlets across Terengganu and Kelantan, subject to applicable laws and pharmacist supervision.

2. Eligibility

You must be at least eighteen (18) years of age, or have the consent of a legal guardian, to access or use the Platform. Certain services — such as digital health consultations or rental of medical equipment — may require additional verification or be subject to further restrictions imposed by applicable laws.

To place an order, you must also:

• Be capable of forming a legally binding contract under Malaysian law
• Provide accurate, current, and complete information
• Have a valid Malaysian delivery address (international shipping is not currently offered)

3. Your account

To place an order or access certain services, you may need to create an account. You agree to:

• Provide accurate and up-to-date information
• Keep your password confidential and secure
• Notify us immediately if you suspect unauthorised access
• Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or are involved in fraudulent activity.

4. Privacy and Data Protection

We are committed to protecting your privacy in accordance with applicable data protection legislation, including the Personal Data Protection Act 2010 (PDPA) and its Amendment 2024, where applicable.

Please refer to our Privacy Policy for detailed information on how we collect, use, disclose, store, and manage your personal data. By using the Platform, you consent to such data processing and warrant that all data provided by you is accurate and up to date.

5. Use of the Platform

You agree to access and use the Platform solely for lawful purposes and in accordance with these Terms. You shall not:

• Use the Platform for any fraudulent, unlawful, or harmful activity
• Interfere with the functionality or security of the Platform
• Upload or transmit any malicious code, viruses, or harmful materials
• Misrepresent your identity or impersonate another individual or entity
• Attempt unauthorised access to restricted sections of the Platform or its systems
• Resell our products without our written authorisation
• Scrape, mine, or extract data from the Platform without permission

We reserve the right to suspend or terminate your access for any violation of these Terms.

6. Pharmacy and Digital Health Services

Where available, the Platform may provide access to licensed pharmacists and digital health services. Such services are subject to:

• Compliance with all applicable laws and professional healthcare standards
• The accuracy and completeness of health information provided by you
• The professional judgment of licensed practitioners, who may, at their discretion, refuse to issue prescriptions or provide advice if insufficient or misleading information is provided

Digital health services, including online consultations or symptom assessments, are intended solely for informational purposes and do not replace professional medical diagnosis or treatment.

7. Health and safety disclaimer

Information on the Platform — including product descriptions, blog articles, and customer support advice — is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

• Always read the label and follow the manufacturer's instructions
• Health supplement claims are based on manufacturer information and are not intended to diagnose, treat, cure, or prevent any disease
• Consult a doctor, pharmacist, or qualified healthcare professional before using any supplement, especially if you are pregnant, breastfeeding, taking medication, or have a medical condition
• If you experience an adverse reaction, stop use immediately and seek medical attention

L&T Pharmacy SB is not liable for any harm resulting from misuse, allergic reactions, or use against medical advice.

8. Product and Service Information

While we endeavour to ensure the accuracy of product descriptions, pricing, availability, ingredients, and other content, the Platform may contain errors or inaccuracies from time to time. We reserve the right to correct such errors without prior notice.

We may change or discontinue products or services at our sole discretion. Product images are for illustrative purposes only — actual products may vary slightly in colour, packaging, or appearance.

All orders are subject to stock availability. If an item is out of stock after your order is placed, we will notify you within 2 business days and offer a substitute, refund, or backorder option.

9. Orders and acceptance

When you place an order, you are making an offer to purchase. We reserve the right to accept or reject any order at our discretion, including in the event of inaccuracies, stock limitations, or suspected misuse. You will receive an order confirmation by email once your order is accepted, which forms a binding contract between you and L&T Pharmacy SB.

Once payment is made, orders cannot be cancelled or modified. Please review your cart carefully — including products, quantities, delivery address, and total amount — before completing payment.

If you receive a damaged, defective, expired, or wrong item, please refer to our Return & Refund Policy to submit a return request within 7 days of delivery.

10. Payment Terms

All transactions made via the Platform are subject to the following terms:

• Prices are listed in Malaysian Ringgit (MYR/RM) and are inclusive of applicable taxes (SST where applicable)
• Payments must be made in full at the time of order using approved payment methods
• You represent and warrant that all payment information provided is accurate and authorised

We accept the following payment methods:

• Online banking / FPX
• Credit and debit cards (Visa, Mastercard)
• E-wallets (Touch 'n Go, GrabPay, Boost, ShopeePay)

All online payments are processed through secure, PCI-DSS compliant payment gateways. L&T Pharmacy SB does not store your full card details. We reserve the right to refuse or cancel any order, including in cases of suspected fraud or unauthorised transactions, and are not liable for delays or failures in transaction processing due to payment system issues.

11. Delivery

11.1 Delivery areas

We deliver throughout Peninsular Malaysia. Delivery to East Malaysia (Sabah and Sarawak) may incur additional charges and longer delivery times.

11.2 Delivery times

• Peninsular Malaysia: typically 3–5 business days
• East Malaysia (Sabah and Sarawak): typically 5–10 business days

These are estimates only. Actual delivery times may vary due to courier delays, public holidays, weather, or other factors beyond our control.

11.3 Delivery charges

Delivery charges are calculated at checkout. We may offer free delivery for orders above a minimum amount as part of promotions.

11.4 Risk of loss

Risk of loss and ownership of the product passes to you once the item is delivered to your address. Please inspect your order on receipt and report any damage or missing items within 48 hours.

11.5 Failed delivery

If a delivery fails due to an incorrect address, no one available to receive the parcel, or refusal to accept, redelivery charges may apply.

12. Medical equipment rentals

Rental items (wheelchairs, hospital beds, oxygen tanks, etc.) are subject to a separate rental agreement signed at the time of equipment collection or delivery. By renting equipment, you agree to:

• Use the equipment only as instructed
• Keep the equipment in good condition
• Return it on or before the agreed date
• Pay for any damage beyond normal wear and tear

13. Returns and refunds

Returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms. Please review it before placing an order.

14. Promotions and Campaigns

Promotional offers, discount codes, coupons, and marketing campaigns offered by us:

• Are subject to specific terms and conditions communicated during the promotion
• Are non-transferable, non-refundable, and may not be redeemed for cash
• May be limited to specific users or time periods

We reserve the right to modify, suspend, or cancel any promotion at our discretion.

15. Membership and Loyalty Programs

Membership and loyalty programs, where offered, are governed by the following conditions:

• Points and rewards earned are personal to the registered account holder and may not be transferred or combined
• Points may have an expiration date or usage restrictions
• Any misuse or fraudulent activity may result in immediate suspension or termination of membership privileges

Additional program-specific terms may apply. We reserve the right to amend, suspend, or terminate any such program without liability.

16. Fraud and Abuse

We maintain a zero-tolerance policy towards fraudulent activities, misuse of services, or abuse of promotions and systems. Any such behaviour may result in:

• Immediate suspension or termination of your account
• Cancellation of orders or revocation of benefits
• Legal action where applicable

17. Intellectual Property

All content available on the Platform — including but not limited to text, graphics, logos, images, audio clips, software, and trademarks — is the intellectual property of L&T Pharmacy SB or its licensors.

You are granted a limited, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial purposes. Any reproduction, distribution, modification, or use of the content beyond the intended scope is strictly prohibited without prior written consent.

18. Reviews and user-generated content

If you submit a product review, comment, photo, or other content:

• You confirm that you own the content or have permission to share it
• You grant L&T Pharmacy SB a non-exclusive, royalty-free licence to use, display, and reproduce it for marketing and operational purposes
• You agree not to submit defamatory, offensive, or misleading content

We reserve the right to remove any user content at our discretion.

19. Our Obligations

We undertake to:

• Ensure the accuracy of the information provided on the Platform, to the best of our ability
• Provide services in a professional, lawful, and diligent manner
• Comply with all applicable regulatory and legal obligations
• Safeguard personal and sensitive data in accordance with data protection laws

However, we do not guarantee continuous or uninterrupted access, absolute accuracy, or complete security of the Platform, and may perform maintenance or updates without notice.

20. Representations, Warranties, and Indemnity

We disclaim all warranties — express or implied — including fitness for a particular purpose, merchantability, and non-infringement.

You agree to indemnify and hold harmless L&T Pharmacy SB, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your breach of these Terms
• Your misuse of our products or services
• Your violation of any applicable law or third-party rights

21. Limitation of Liability

To the fullest extent permitted by applicable law, L&T Pharmacy SB shall not be liable for any:

• Indirect, incidental, consequential, special, or exemplary damages
• Loss of profits, revenue, data, or goodwill
• Claims arising from your reliance on any content or services provided on the Platform
• Delays caused by couriers, payment processors, or other third parties

Our total liability, whether in contract, tort, or otherwise, shall be limited to the amount paid by you for the product or service giving rise to the claim, if any.

Nothing in these Terms limits liability for death, personal injury, or fraud where such limitation is prohibited by law.

22. Force Majeure

We are not liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including:

• Natural disasters, floods, monsoons
• Pandemics or public health emergencies
• War, terrorism, civil unrest
• Government action or regulatory changes
• Power outages, internet outages, or courier disruptions

23. Termination

We may suspend or terminate your access to the Platform or services at any time, with or without notice, if you breach these Terms or engage in conduct we deem harmful.

You may close your account at any time by contacting us. Closure does not affect orders already placed or obligations already incurred.

24. Governing Law and Entire Agreement

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and L&T Pharmacy SB in relation to your use of the Platform and supersede any prior agreements or understandings.

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia. We encourage you to contact us first to resolve any issues amicably before pursuing legal action.

L&T Pharmacy SB reserves the right to revise this document at any time, with changes effective upon posting.
